1. PARTIES AND DEFINITIONS
1.1 These Booking Terms & Conditions ("Booking Terms") form the contract between Ms. Manasi Ashok Kadam, sole proprietor, carrying on business under the registered trade name "Magna Voyage" and operating the brand and website "Magna Voyagee" ("Magna Voyagee", "we", "us", "our"), and the person named as lead traveller on the Booking Confirmation ("you", "Lead Traveller"), on behalf of all persons named in that booking ("Travellers").
1.2 Definitions.
- "Booking Confirmation" — the written confirmation we issue setting out the Travellers, dates, services, inclusions, exclusions and total price.
- "Supplier" — any third party providing a component of your travel: airline, hotel, resort, homestay, camp, transport operator, driver, guide, tour leader, activity or adventure operator, destination management company, visa agency, insurer, or permit authority.
- "Tour" — the travel arrangements described in the Booking Confirmation.
- "Force Majeure" — as defined in Clause 14.
- "Departure Date" — the first date of travel shown on the Booking Confirmation.
1.3 These Booking Terms prevail over any inconsistent statement in a brochure, on our website, on social media, or in pre-contract correspondence.
2. OUR ROLE — PLEASE READ THIS CAREFULLY
2.1 Magna Voyagee is a travel agent and tour organiser. We select, book and coordinate services provided by independent Suppliers.
2.2 Except where we expressly state in writing that we are providing a service ourselves, we act as agent for the Suppliers and not as principal. The contract for each travel service — the flight, the room, the vehicle, the activity — is between you and that Supplier, on that Supplier's own terms and conditions, which may limit or exclude their liability.
2.3 We undertake to exercise reasonable skill and care in selecting reputable Suppliers and in arranging and coordinating your Tour. That is the standard against which our performance is to be judged.
2.4 Subject to Clause 15, we are not liable for the acts, omissions, defaults, negligence or insolvency of any Supplier, or for any deficiency in a service performed by a Supplier, where we have exercised reasonable skill and care in their selection.
2.5 Where a Supplier fails you, we will use reasonable endeavours to assist you in pursuing a claim against that Supplier, including by providing booking references and correspondence.
3. BOOKING AND CONTRACT FORMATION
3.1 All quotations are valid for 7 days from issue and are subject to availability at the time of confirmation. Availability is not held or blocked until a booking amount is received.
3.2 A binding contract comes into existence only when: (a) we issue a written Booking Confirmation; (b) you confirm acceptance of these Booking Terms in writing (by email, signed booking form, or acceptance of a digital booking form); and (c) we receive the booking amount in cleared funds.
3.3 The Lead Traveller must be at least 18 years old and warrants that they are authorised to make the booking on behalf of, and accept these Booking Terms for, all Travellers named, and that they have obtained each Traveller's consent to the processing of their personal data as described in our Privacy Policy.
3.4 The Lead Traveller is responsible for all payments due in respect of the booking and is our primary point of contact for all communications, which shall be deemed communicated to all Travellers.
3.5 Please check your Booking Confirmation immediately on receipt. Notify us of any error within 48 hours. We cannot accept responsibility for errors notified after that period, and amendment charges under Clause 7 will apply.
4. PRICES, TAXES AND WHAT IS INCLUDED
4.1 The price in your Booking Confirmation is the total price for the services listed. Only what is expressly listed as an inclusion is included.
4.2 Unless expressly stated as included, the following are excluded and payable by you: international and domestic airfares; visa fees and service charges; travel insurance; passport fees; airport taxes and development fees; excess baggage; meals not specified; all beverages including bottled water and alcohol; personal expenses, laundry, telephone and internet; tips and gratuities to drivers, guides and hotel staff; camera and video permit fees at monuments; optional activities and excursions; medical costs, evacuation and rescue; monument and park entry fees not listed; anything arising from Force Majeure; and anything not expressly listed as an inclusion.
4.3 Goods and Services Tax (GST) and all other applicable statutory taxes, cesses and levies are payable in addition unless the Booking Confirmation states the price is inclusive.
4.4 Price variation. The price is based on costs, exchange rates, fuel prices, airfares and taxes prevailing at the date of quotation. We reserve the right to increase the price before departure where there is an increase in: (a) transport costs including fuel; (b) airfares, where tickets are not yet issued; (c) government-imposed taxes, fees, levies or GST rates; (d) permit, park or monument entry fees; or (e) exchange rates applicable to the arrangements.
4.5 We will notify you of any increase in writing with a breakdown of the cause. If the increase exceeds 10% of the total price, you may cancel within 7 days of our notice and receive a full refund of amounts paid, less any genuinely non-refundable third-party costs already incurred and evidenced.
4.6 No price reduction is payable for services included in the price but not used by you, whether meals, excursions, transfers, accommodation nights or activities, unless we recover a refund from the Supplier, in which case we will pass on what we recover.
5. PAYMENT
5.1 Payment schedule (unless otherwise stated in your Booking Confirmation):

5.2 Bookings made within 30 days of the Departure Date require payment in full at the time of booking.
5.3 Payment is by bank transfer or UPI to the account specified on our invoice, or by a payment link issued by a regulated payment provider. We do not accept card details by email, WhatsApp or telephone.
🔒 FRAUD WARNING. Our bank account details appear only on our official invoice. We will never change our bank details by email or WhatsApp mid-transaction. If you receive any communication asking you to pay to a different account, do not pay — call us on +91 88509 16203 to verify. We accept no liability for payments made to accounts not specified on our official invoice.
5.4 Time is of the essence in relation to payment. If any payment is not received by its due date, we may, after giving you 7 days' written notice to remedy, treat the booking as cancelled by you and apply the cancellation charges in Clause 6.
5.5 Airline tickets, permits and certain hotel reservations are issued only on receipt of full payment for those components. Fares, availability and permit allocations are not guaranteed until issued, and may change until that point.
6. CANCELLATION BY YOU
6.1 Cancellation must be notified in writing to magnavoyage@gmail.com and takes effect only from the date we acknowledge receipt in writing.
6.2 Cancellation charges are calculated on the total price as a percentage, based on the number of clear days before the Departure Date on which we receive written notice:

6.3 In addition to the above, the following are non-refundable in all cases, to the extent already incurred: issued air, rail and ferry tickets (refundable only to the extent the carrier refunds, less its charges); visa fees, whether or not the visa is granted; permit fees including Inner Line and protected-area permits; travel insurance premiums; non-refundable hotel prepayments and peak-season deposits; and any Supplier charge we have irrecoverably incurred.
6.4 Where actual non-refundable costs exceed the percentage in the table, the actual documented cost applies. We will provide evidence of such costs on request.
6.5 Refunds due will be processed within 15 working days of the cancellation taking effect, to the account from which payment was received. Bank charges and foreign exchange losses are for your account. Refunds of foreign-currency components are at the exchange rate on the date of refund, not the date of payment.
6.6 Partial cancellation. If one or more Travellers cancel but the booking proceeds, cancellation charges apply to the cancelling Travellers, and the remaining Travellers will be re-priced — for example from twin-sharing to single occupancy — and the difference is payable.
6.7 We strongly recommend travel insurance covering cancellation. See Clause 11.
7. AMENDMENTS BY YOU
7.1 We will use reasonable endeavours to accommodate changes, but cannot guarantee them.
7.2 Each amendment attracts an administration fee of ₹2,000 per Traveller per amendment, plus any charges levied by Suppliers, plus any difference in price arising from the change.
7.3 A change of Departure Date, a material change of destination, or a reduction in duration of more than 3 days will be treated as a cancellation and rebooking, and Clause 6 applies.
7.4 Name changes. Where permitted by Suppliers, a Traveller may transfer their booking to another person meeting all the requirements of the Tour, on payment of the amendment fee and all Supplier charges, provided we receive written request at least 15 days before departure. Airline tickets are generally non-transferable, and a new ticket may need to be purchased at prevailing fares.
8. CANCELLATION OR CHANGE BY US
8.1 Minimum numbers. Group departures require a minimum of 6 Travellers. If that minimum is not met, we may cancel by giving you not less than 30 days' written notice before departure.
8.2 We may also cancel where required by Force Majeure (Clause 14), or where you fail to pay in accordance with Clause 5.
8.3 If we cancel (other than for your non-payment or Force Majeure), you may choose either: (a) an alternative Tour of comparable standard, with any price difference payable or refundable; or (b) a full refund of all monies paid. This is the limit of our liability for such cancellation, and we shall not be liable for any consequential loss, including airfares, visa fees, insurance premiums, loss of holiday enjoyment, or loss of earnings, where you have booked those independently.
8.4 Minor changes. Travel arrangements change. We may make minor changes — a hotel substituted for another of comparable or higher standard, a change of room category, a reordering of sightseeing, a change of vehicle type or flight timing — without liability. We will notify you as soon as reasonably practicable.
8.5 Significant changes. If we make a significant change before departure — a change of destination, a reduction of more than 2 nights, a downgrade to a materially lower accommodation standard for the majority of the Tour, or a change of Departure Date by more than 24 hours — you may accept the change, accept an alternative Tour offered, or cancel and receive a full refund. You must tell us your choice within 7 days of our notification, failing which you are deemed to have accepted the change.
9. ITINERARY VARIATION DURING TRAVEL — MOUNTAIN AND REMOTE TRAVEL
9.1 You acknowledge that itineraries in Himalayan, high-altitude, remote and international destinations are inherently subject to change.
9.2 We, our tour leaders, guides and drivers may alter, curtail, reroute or omit any part of the itinerary at any time where reasonably necessary for the safety, security or welfare of Travellers, or where required by circumstances beyond our control, including: road closure, landslide, snowfall, avalanche, flooding or washed-out bridges; pass closure (including but not limited to Kunzum, Rohtang, Baralacha, Khardung La and Chang La); adverse or extreme weather; flight cancellation, delay, diversion or rescheduling; refusal or delay of permits by authorities; strikes, bandhs, curfew, protest or road blockade; political instability, security alert or military restriction; vehicle breakdown in remote terrain; medical emergency affecting any Traveller; or overbooking or closure by a Supplier.
9.3 In such circumstances we will use reasonable endeavours to provide a comparable alternative. Where a substitute of comparable standard is provided, no refund is due. Where a component cannot be provided or substituted, we will refund only such amount as we actually recover from the relevant Supplier.
9.4 Additional costs arising from such variation — extra hotel nights, extra meals, extra transport, rerouted or rebooked flights, extended vehicle hire — are payable by you, as they are costs we incur on your behalf and are typically recoverable under travel insurance. We will consult you where circumstances reasonably permit; where they do not permit, and a decision must be taken in the interest of safety, our decision is final and the costs remain payable by you.
9.5 The tour leader's or guide's decision on matters of safety, routing and participation is final and binding.
10. HEALTH, FITNESS AND HIGH-ALTITUDE TRAVEL
This clause is critical for our Himalayan itineraries. Please read it in full.
10.1 Fitness declaration. You warrant that each Traveller is medically and physically fit to undertake the Tour, and that you have disclosed to us in writing before booking every medical condition, disability, allergy, dietary requirement, pregnancy, mobility limitation, mental-health condition or course of medication that may affect participation, or that may require assistance or special arrangements.
10.2 High-altitude risk — acknowledgement. You acknowledge and accept that certain of our itineraries — including but not limited to Spiti, Kinnaur, Ladakh, Sikkim, Bhutan, Nepal and other mountain destinations — involve travel to elevations exceeding 3,000 metres and in some cases exceeding 5,000 metres above sea level, where:
- Acute Mountain Sickness (AMS) is common and can affect any person regardless of age or fitness;
- AMS can progress to High Altitude Pulmonary Edema (HAPE) or High Altitude Cerebral Edema (HACE), which are life-threatening medical emergencies;
- oxygen levels, temperature and weather are extreme and unpredictable;
- medical facilities are limited, basic, or many hours away, and specialist care may be a full day's travel or an air evacuation distant;
- mobile network and internet coverage is intermittent or absent over long stretches;
- roads are unpaved, exposed, subject to landslide and rockfall, and travel times may greatly exceed estimates;
- evacuation, where required, may be delayed by weather, terrain or the closure of passes, and cannot be guaranteed.
10.3 You confirm each Traveller has considered these risks, has consulted a qualified medical practitioner where they have any pre-existing condition — in particular cardiac, respiratory, blood-pressure, diabetic, neurological or haematological conditions, or pregnancy — and travels at their own risk and on their own informed decision.
10.4 Evacuation and medical costs. All costs of medical treatment, hospitalisation, oxygen, ambulance, helicopter or road evacuation, repatriation, and any accompanying person's costs are payable by you, whether incurred on your instruction or arranged by us in an emergency where you are unable to instruct us. Where we incur such costs on your behalf, you shall reimburse us on demand. These costs can be very substantial and are precisely what travel insurance exists to cover.
10.5 Right to refuse or remove. We, our tour leader, guide or driver may refuse to allow a Traveller to commence or continue any part of a Tour where, in our reasonable opinion, their physical or mental condition makes participation unsafe for themselves or others. No refund is due in such case, and any costs of onward travel, accommodation or return are payable by the Traveller.
10.6 Non-disclosure. If a material medical condition is not disclosed at the time of booking, and it results in the Traveller being unable to participate, requiring assistance, requiring evacuation, or being refused participation, we accept no liability, no refund is due, and all resulting costs are payable by the Traveller.
10.7 We are not qualified to assess your medical fitness and do not warrant that any itinerary is suitable for any particular Traveller.
11. TRAVEL INSURANCE
11.1 Comprehensive travel insurance is mandatory for all international Tours and strongly recommended for all domestic Tours.
11.2 Your policy should cover, at minimum: medical expenses and hospitalisation abroad; emergency evacuation and repatriation, including helicopter evacuation from remote and high-altitude areas; cancellation and curtailment; trip delay and missed connection; loss of baggage and personal belongings; loss of passport; personal accident; and — where applicable — adventure activities, trekking and high-altitude cover, which many standard policies specifically exclude.
11.3 It is your responsibility to check that your policy actually covers the altitude and activities in your itinerary. Many standard policies exclude altitudes above 3,000m or 4,000m.
11.4 You must carry policy details on the Tour and provide them to us on request.
11.5 Where you travel uninsured or underinsured, you do so entirely at your own risk and accept full financial responsibility for all costs that would otherwise have been covered.
12. PASSPORTS, VISAS, PERMITS AND STATUTORY REQUIREMENTS
12.1 It is your sole responsibility to ensure each Traveller holds a valid passport (generally with at least six months' validity beyond the date of return and adequate blank pages), all required visas and entry authorisations, all required permits, and all required health certificates and vaccinations.
12.2 Any information we give on visas, permits, vaccinations or entry requirements is general guidance only, is not advice, and must be verified independently with the relevant embassy, consulate or authority. Requirements change without notice and differ by nationality.
12.3 Where we assist with a visa or permit application, we do so as your agent for a service fee and give no guarantee of outcome. Grant or refusal is entirely at the discretion of the issuing authority. Fees are non-refundable whether or not the application succeeds.
12.4 Certain Indian destinations require Inner Line Permits or protected-area permits. These are issued at the discretion of the authorities, may be refused or delayed, and may be unavailable to certain nationalities. We accept no liability for refusal, delay or subsequent cancellation of a permit.
12.5 We accept no liability whatsoever where a Traveller is denied boarding, denied entry, deported, detained or fined by reason of defective documentation, insufficient passport validity, absence of a visa or permit, name mismatch between ticket and passport, or non-compliance with any immigration or health requirement. No refund is due, cancellation charges under Clause 6 apply in full, and all resulting costs are payable by the Traveller.
12.6 Names on all bookings must exactly match the government photo identification or passport that will be presented. You are responsible for providing correct spellings. Correction charges levied by airlines and Suppliers are payable by you.
13. CONDUCT AND BEHAVIOUR
13.1 Travellers must conduct themselves with respect for fellow Travellers, our staff, Suppliers' staff, and local communities, customs and law.
13.2 We may terminate the Tour of any Traveller whose behaviour, in our reasonable opinion or that of our tour leader, guide, driver or any Supplier, is likely to cause danger, distress, damage or serious annoyance to others, or breaches local law. This includes intoxication, use of illegal substances, harassment of any kind, and refusal to follow reasonable safety instructions.
13.3 In such case the contract with that Traveller ends immediately, no refund is due, we have no further liability, and all costs of onward travel and accommodation are payable by that Traveller. Local law applies to any offence committed, and penalties in some destinations are severe.
13.4 Damage. Travellers are liable for any damage caused to accommodation, vehicles or property, and must settle such claims directly with the Supplier. Where we are pursued for such a claim, you shall indemnify us in full, including reasonable legal costs.
13.5 Group travel involves shared vehicles, shared timings and shared decisions. Travellers are expected to adhere to schedules communicated by the tour leader; we accept no liability where a Traveller misses a service, transfer or departure by reason of their own lateness.
14. FORCE MAJEURE
14.1 We shall have no liability where the performance or prompt performance of our obligations is prevented, affected or delayed by Force Majeure, meaning any circumstance beyond our reasonable control, including: act of God, earthquake, landslide, avalanche, flood, cloudburst, cyclone, extreme or adverse weather; fire or explosion; epidemic, pandemic, public-health emergency, quarantine or travel restriction; war, threat of war, invasion, terrorism or threat of terrorism, civil unrest, riot, insurgency, bandh or curfew; strike or industrial action, including by airline, transport, hotel or airport staff; act, order, restriction or advisory of any government or authority, including border closure, airspace closure, permit refusal, road closure and lockdown; nuclear or chemical incident; airport or port closure; failure or insolvency of any Supplier; and technical or mechanical failure of transport.
14.2 Where a Tour is cancelled, curtailed or altered by reason of Force Majeure, we will refund such amounts as we are actually able to recover from Suppliers, less our reasonable administrative costs and any non-recoverable amounts already paid. We shall not be liable to refund amounts we cannot recover, and shall have no liability for any consequential loss.
14.3 Where possible, we may instead offer a credit note valid for 12 months, at your election.
14.4 Costs incurred by reason of Force Majeure during travel — additional nights, meals, transport, rebooked flights — are payable by you and are typically recoverable under travel insurance.
15. LIABILITY
15.1 We accept liability for loss or damage directly caused by our failure to exercise reasonable skill and care in arranging and coordinating your Tour.
15.2 Subject to Clause 15.5, our total aggregate liability to all Travellers on a booking, for any and all claims arising out of or in connection with that booking, shall not exceed the total price paid by you to us for that booking, excluding amounts paid in respect of airfares, insurance premiums, visa fees and other third-party pass-through costs.
15.3 Subject to Clause 15.5, we shall not be liable for: indirect or consequential loss; loss of enjoyment beyond the value of the affected service; loss of profit, income, earnings, business or opportunity; loss, theft or damage to money, jewellery, electronics, documents or personal belongings (which remain your responsibility at all times, and for which safe-deposit and insurance are recommended); any loss covered or coverable under a travel insurance policy; injury, illness or death not arising from our failure to exercise reasonable skill and care; any act, omission, default or negligence of a Supplier, subject to Clause 2; anything arising from Force Majeure; or anything arising from your own act, omission, non-disclosure or breach of these Booking Terms.
15.4 Where liability arises from a service performed by a Supplier, our liability shall not exceed that of the Supplier under its own conditions of carriage or contract, and under any applicable international convention — including the Montreal Convention 1999 and the Warsaw Convention in respect of air travel, and any convention applicable to rail, sea or hotel accommodation. Such conventions may substantially limit the compensation payable.
15.5 Nothing in these Booking Terms excludes or limits our liability where such exclusion or limitation is prohibited by law, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or any liability that may not lawfully be excluded under the Consumer Protection Act, 2019.
15.6 Nothing in these Booking Terms is intended to exclude, restrict or defeat any statutory right available to a consumer under the Consumer Protection Act, 2019.
16. COMPLAINTS
16.1 If you have any complaint during your Tour, you must report it immediately to your tour leader, guide or local representative, and to us on +91 88509 16203, so that we have a fair opportunity to investigate and remedy it while you are still travelling.
16.2 If the matter cannot be resolved on the spot, you must confirm the complaint in writing to magnavoyage@gmail.com within 30 days of the completion of your Tour, with supporting details, photographs and any reference numbers.
16.3 Failure to follow Clauses 16.1 and 16.2 may prejudice our ability to investigate and resolve the matter, and may be taken into account in assessing the complaint and any compensation.
16.4 We will acknowledge your complaint within 48 hours and respond substantively within 30 days.

17. SPECIAL REQUESTS
We will pass on special requests — room location, bed configuration, adjoining rooms, dietary requirements, celebrations, early check-in, late check-out — to Suppliers, but cannot guarantee them. A special request is not a term of your contract, and its non-fulfilment is not a breach. Where a requirement is essential, tell us before booking and we will confirm in writing whether it can be guaranteed; only a written confirmation from us makes it a term of the contract.
18. ACCOMMODATION
18.1 Star ratings and categories reflect local classification standards, which vary considerably between countries and may not correspond to Indian or international expectations.
18.2 Standard check-in is generally 1400 hrs and check-out 1100 hrs local time, regardless of your arrival or departure time. Early check-in and late check-out are subject to availability and may attract charges.
18.3 Triple rooms are commonly a twin room with an extra mattress or rollaway bed, and are generally not larger than a twin room.
18.4 In remote and mountain locations, accommodation may be basic homestays, guesthouses or camps, and hot water, heating, continuous electricity, Wi-Fi and attached bathrooms may be limited or unavailable. This is inherent to the destination and is not a deficiency in service.
18.5 Where a named property becomes unavailable, we may substitute a property of comparable or higher standard; this is a minor change under Clause 8.4.
19. PHOTOGRAPHY AND MARKETING
19.1 Photographs and video may be taken during the Tour by our tour leaders, guides or fellow Travellers.
19.2 We will use images in which a Traveller is identifiable in our marketing, website, blog or social media only with consent. Consent is requested on the booking form and may be refused with no effect on your booking.
19.3 Consent may be withdrawn at any time by writing to magnavoyage@gmail.com, and we will remove the image from channels we control within a reasonable period. See Section 11 of our Privacy Policy.
19.4 Travellers photographing others in the group should obtain their agreement before posting publicly.
20. DATA PROTECTION
Personal data is processed in accordance with our Privacy Policy at https://magnavoyagee.com/privacy-policy/, which forms part of these Booking Terms. You acknowledge that data necessary to fulfil an international booking will be transferred outside India to Suppliers in the destination country, as described in Section 8 of that Policy.
21. GOVERNING LAW AND DISPUTE RESOLUTION
21.1 These Booking Terms are governed by the laws of India.
21.2 Amicable resolution. Any dispute shall first be raised by written notice, and the parties shall attempt in good faith to resolve it within 30 days.
21.3 Arbitration. Failing resolution, the dispute shall be referred to and finally resolved by arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. Seat and venue: Mumbai, Maharashtra. Language: English. The award shall be final and binding.
21.4 Jurisdiction. Subject to Clause 21.3, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction.
21.5 Consumer rights preserved.
Nothing in Clauses 21.3 or 21.4 restricts the right of a "consumer" under the Consumer Protection Act, 2019 to approach a Consumer Disputes Redressal Commission of competent jurisdiction. Following Emaar MGF Land Ltd. v. Aftab Singh (2018), consumer disputes are not arbitrable at the election of the consumer, and this clause does not oust the jurisdiction of consumer fora.
22. GENERAL
22.1 Severability. If any provision is held invalid or unenforceable, it shall be severed and the remainder shall continue in full force.
22.2 No waiver. Failure to enforce any provision is not a waiver.
22.3 Entire agreement. These Booking Terms, together with the Booking Confirmation and the Privacy Policy, constitute the entire agreement between us and supersede all prior discussions, representations and correspondence. No employee or representative has authority to vary these Booking Terms other than in writing signed by the proprietor.
22.4 Version. The Booking Terms applicable to your booking are those in force on the date of your Booking Confirmation. Later revisions do not affect a confirmed booking.
22.5 Language. English prevails over any translation.
23. TRAVELLER ACCEPTANCE
Do not accept payment until this is completed and returned.
I confirm that I have read, understood and accept these Booking Terms & Conditions on my own behalf and on behalf of all Travellers named in the booking, having their authority to do so. I confirm in particular that I have read and understood Clause 2 (Our Role), Clause 6 (Cancellation Charges), Clause 10 (Health, Fitness and High-Altitude Travel), Clause 11 (Travel Insurance), Clause 12 (Passports, Visas and Permits) and Clause 15 (Liability).
